There is no such thing as an "unlawful ban" bans do not fall under the DOJ, Courts or Constitution.

Freedom to speak does not mean freedom from the consequences of said speech.

Precisely. The amendments are all about what the government can and cannot do, not so much private individuals.

If you'll read, "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

 

"Congress shall make no law." It does not say anything about IRC server owners setting rules, does it?
